Yes, a new sub-forum where we can post things about laws in different countries, Procedures to aquire permits/licenses and general laser law discusion would be a good idea.

UPDATE on NSW Laser Laws.

As of June 19, 2008 (just 12 days before the new laws come into effect), I've contacted the Firearms Registry and the NSW Police Force in relation to the upcoming laws. Politicians, Police and even the NSW Firearms Registry, which is handling the new Permits for Class 3B laser users, are unaware of what the new laws will require.

To quote the NSW Police: "The new laws are still Under Review"

This means that nobody knows quite what to do about Class 3B lasers at this time. It also means that there are no clear instructions for owners and law enforcement alike. Sadly, it pretty much forces all legitimate users and owners to become criminals since most Prohibited Weapons Licenses take 40 days to process.

One thing that is good to note is that members of Astronomical Societies are in the legitimate users group. Also, there is apparently no fee required for applying for the permit to own these (soon to be) Prohibited Weapons. What this will possibly mean is that owners will be (in theory) able to apply for a License at no cost to own these lasers. I assume that a criminal background check will be in place. This would most likely mean that people wishing to import a Class 3B laser would be able to obtain them as long as they were Licensed to own the item.

More to come as people figure out what on earth it is that we are required to do.

Too bad I am too young/lazy/uneducated on how to sue someone for quoting me and mentioning my name without permission etc...

Anyways...

I will have to search this again, but I have read somewhere that if you import a laser from New Zealand or something like that its still legal, or something along the lines of shipping it from island to island, im not too sure but apparently there are other things being importated that way...

Yes, it is. You see, even if new laws come and go, the Courts have determined that "Ignorance is no excuse for breaking a law". Put simply, just because you don't know something is illegal, it does not in any way make you exempt from legal prosecution.

As for importing from New Zealand, you could probably import from any place in the world as long as you seek permission to do so via the Police and Customs. Thus you would need to show reason or justification to own what you intend to import. Importing from New Zealand would technically be the same as importing from any overseas location.

Lastly: Suing someone is easy. You ask your lawyer to do the paperwork and send it on to the (soon to become ) defendant. You just need to show that you are within your legal rights to do so. People in the media are permitted to use information they discover in the course of their investigations as "fair use" if the material is in public domain. But a person who has been victimized by poor research could easily show (if they were misquoted or especially if the information was inaccurate) that their name and reputation has been affected by reckless and poorly researched reporting. This is why Hollywood stars are able to sue for millions when their names are used without permission or they are slandered by false or inaccurate comments about themselves.

You might be amused to hear that when you submit information to the Daily Telegraph (the paper responsible for the recent hysteria and poorly researched & inaccurate laser news) that you have to agree to the following submission terms: that they may block your submission if the information contained is false or misleading. Way to go, hypocrites.

Ah ok... well... If I remember correct about you talking about BATTERY operated laser... next thing you know the whole laser industry will switch to some new technology and/or adapt and conform to these new rules.

And honestly, I really think something will happen before or after these laws will become effective, if its either people not obeying it (mass rebellion or something of the sort.... MARCH OF THE LASERISTS hehehe, and people like you and others, the goverment bailing out on the idea of attempting something pretty much unachievable and rediculous etc...)

My suggestion I had regards if collective suing works in some way... since he mentioned a couple of people at once and even wickedlasers (I am not 100% sure if im correct) (mentioning that one "special' laser everyone wants to import before its illegal, Im not too sure what he ment)

Theres is no real time limit on when I have to sue to when the article was published etc... or am I wrong?

And since it is published there is no going back for him correct?

Battery powered eh? I think I might have figured out a solution to make everyone (here anyways, those who matter) happy! Basically take the existing design of a wicked laser, no need to modify it. Have an AC/DC adapter, then send the 3V DC current down a wire. It will screw into a modified end cap, inside there will be a conductive blank of some sort that will be the size of two AAA batteries - easily removable for cleaning purposes. Plug the adapter into the wall, DC goes down the wire into the housing and powers the laser. Now if a couple of bad apples were to seek WL to acquire a standard end cap and replace the internal blank with two batteries on their own... Long story short: Sell an "Australian AC powered model" that might be 'modded' into a standard version.

On another note, question Nero himself:
What is going to happen to those who already have high powered lasers? As soon as the law passes, are they instantly criminals who need to <do what exactly> to comply with the law? What exactly are your plans when this comes around?

I am following this thread closely though I've noticed its mostly in relation to the NSW laws.

I have spent some time looking around and have been unable to find any solid information about the laws in Queensland, particularly in regards to class 3B lasers. It is worrying to own these lasers as many people know I have had them for a long time, even prior to the media uprising against lasers.

If they are banned I'm sure the faculty of science at a nearby university will be interested in acquiring them free-of-charge. It's either that or smash them with a hammer while video taping proof of their destruction.

Nice article Nero. Though in the demotivator in the OP, that keychain laser looks to me like an LED Lenser keychain light. They have those warning stickers on them. =P
